Exceptions & Limitations

to Copyright and Creative Commons Licenses

(Because Creative Commons licenses work within copyright law, any exceptions to copyright also apply under a CC license).

• Fair Use 

            Use of material under Fair Use Guidelines also applies to material under a CC license.

• Public Domain

            Works in the public domain do not need CC licensing because the works are already unrestricted.  

• Privacy Rights

            CC licenses don't have any impact on rights beyond copyright, like privacy rights.

• Software

            CC licensing doesn't adequately address software sharing parameters.  Creative Commons recommends using open source software licensing instead.
